DISTANCE SALES CONTRACT

1. Parties
This Distance Sales Contract has been established electronically between the Seller, whose information is provided below, and the Buyer, who places an order through the website.

2. Subject of the Contract
The subject of this contract is to determine the sale, production, preparation, delivery, payment conditions, right of withdrawal, return conditions, and the rights and obligations of the parties regarding the product or products ordered electronically by the Buyer through the Seller's website. In distance contracts, it is mandatory to provide clear preliminary information and basic details to the consumer before the contract is established.
3. Product / Order Information
The type, model, quantity, unit price, total sales price, shipping cost (if any), delivery information, and payment method of the products subject to the order are valid as specified in the order summary, payment screen, and order confirmation email shown to the Buyer at the moment the order is created.
4. Order and Payment Process
- 4.1. The Buyer shall review product information, price, additional costs (if any), and delivery details before creating an order and then confirm the order.
- 4.2. Upon completion of the order, the Buyer acknowledges being under a payment obligation. In distance selling, this matter must be clearly displayed at the time of the order.
- 4.3. The Seller may collect the payment for the order via bank/credit card, wire transfer/EFT/international transfer, or other payment methods offered on the website.
- 4.4. The production and shipment process shall not commence before the payment is received or the order is confirmed by the Seller.
5. Nature of Products and Production Model
- 5.1. Some products offered by the Seller are ready-made items, while others are manufactured to order / personalized / revised according to customer demands.
- 5.2. Custom-made products can be prepared in line with personal/commercial requests such as city name, institution name, logo, custom text, custom color, custom pattern, custom dimensions, custom collection, custom printing, or similar customer demands.
- 5.3. The Buyer acknowledges that depending on the nature of the order, the product may not be a standard stock item, but a custom-produced product prepared according to their specific request.
6. Approval Process and Commencement of Production
- 6.1. For custom production or orders requiring revision, the Seller may present the Buyer with sample images, digital designs, mockups, photographs, videos, or similar preview materials prior to production.
- 6.2. The production process begins after approval is given by the Buyer in writing, via email, through a messaging application, or similar permanent data storage mediums. Providing information to the consumer through a permanent data storage medium carries great legislative importance.
- 6.3. For custom production orders taken into manufacturing following the Buyer's explicit approval, the product is deemed to be uniquely prepared according to the Buyer's requirements.
7. Delivery and Production Period
- 7.1. The production and preparation time of the products subject to the order may vary depending on the nature of the product, quantity, customization status, order density, and the date of Buyer approval.
- 7.2. For custom-made products, the delivery period begins after the Buyer's approval.
- 7.3. Shipping / transit time is separate from production time. The Seller is not responsible for delays caused by the shipping company; however, the Seller will provide reasonable support.
- 7.4. On international orders, additional processes may occur due to customs, local taxes, import costs, transit times, and country regulations. There is an obligation to inform the consumer about additional costs before ordering.
8. Right of Withdrawal
- 8.1. The Buyer has the right of withdrawal within the scope of distance contracts in cases provided for by legal regulations.
- 8.2. However, pursuant to the Regulation on Distance Contracts, there is an exception to the right of withdrawal for goods prepared in line with the consumer's explicit requests or personal needs.
- 8.3. Within this scope; the right of withdrawal may not be applicable for products designed or personalized according to the Buyer's specific request, containing a city/name/logo/institution/custom printing/custom color/custom text/custom size, or put into production after the Buyer's approval. This exception is also explicitly stated in the guidelines of the Ministry of Trade.
- 8.4. For ready-made, standard, and non-personalized products, the provisions of the current legislation shall apply.
9. Return, Exchange, Defective and Damaged Products
- 9.1. Arbitrary returns are not accepted for custom-produced products; however, the following situations are evaluated separately:
• The product being manufactured in clear contradiction to the Buyer's approval, • Presence of a manufacturing defect, • Incorrect product delivery, • Visible damage occurring during transit, • Presence of a printing or manufacturing flaw.
- 9.2. If the Buyer believes that there is damage, defect, or a non-compliance with the approval in the delivered product, they must notify the Seller in writing within a reasonable time from the delivery date and, if possible, support the situation with photos/videos.
- 9.3. If the Seller deems it appropriate according to the evaluation results, they may offer remanufacturing, correction, exchange, or a similar reasonable solution.
- 9.4. Limited tone or minor size differences may occur between the screen image, digital preview, mockup, and physical printing / production due to the materials used, printing technique, screen settings, and production tolerances. Such reasonable variations do not constitute a defect on their own.
10. Color, Size, and Visual Differences
- 10.1. Product images are for illustrative purposes. Minor variations in color tones may occur depending on screen calibration, device differences, printing technique, material surface, and production conditions.
- 10.2. Reasonable dimensional tolerances may occur due to handcrafting, CNC cutting, UV printing, material structure, and production technique.
- 10.3. The Buyer acknowledges that reasonable technical variations may occur due to the nature of the production technique.
11. Force Majeure
In cases of natural disasters, war, terrorism, epidemics, strikes, logistical disruptions, import/export restrictions, technical infrastructure failures, payment system issues, carrier-related general interruptions, and similar events beyond the control of the parties, the Seller will make the necessary efforts to fulfill its obligations within a reasonable period; however, it cannot be held directly responsible for delays resulting from these circumstances.
12. Delil Sözleşmesi
The parties agree that in disputes that may arise from this contract, the commercial books and records, order records, payment records, email correspondence, messaging records, confirmation messages, image/video shares, and system logs belonging to the Seller may be taken into consideration as evidence.
13. Dispute Resolution
In disputes that may arise from this contract, the provisions of the current consumer legislation shall apply. Law No. 6502 and relevant legislation shall be taken as a basis regarding the authorized and competent authorities in consumer disputes.
14. Enforcement
By completing the order on the website, the Buyer declares that they have read, understood, and accepted all the provisions of this contract. This contract enters into force upon electronic approval of the order.
